Nebraska’s Attorney General Says Big Ten Out of Compliance with NE Law Governing Nonprofits

LINCOLN – Nebraska’s Attorney General, Doug Peterson, issued a letter to the to The Big Ten Conference, Inc., through Commissioner Kevin Warren, notifying the Commissioner that the Conference appears to be out of compliance with the Nebraska Nonprofit Corporation Act.
The Attorney General’s Office is responsible for overseeing compliance with the Act by nonprofit organizations operating in Nebraska. “We have instructed Conference officials to provide us with documents and records to determine if they have operated in compliance with Nebraska law and their own governing documents,” with regard to transparency and public information law, according to AG Peterson.
“In order to receive the [tax exemption] advantages to operate as a nonprofit organization in Nebraska, it is imperative that the organization operate with complete transparency regarding its decision-making process. Nebraskans expect transparency from nonprofits operating in this state, and the Big Ten Conference is no exception,” stated Peterson.
In the letter, the Attorney General requests an expansive list of documentation, including a batch of paperwork relating to the “deliberative process” that resulted in the postponement of the 2020 sports season, including internal memos and communications. Additionally, the AG has requested tax forms, lists of directors and Council of Presidents members, and a list of meetings where the season suspending decision was made.
